Welcome to myBloom Superfoods (“myBloom,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, any pages linking to these Terms, and the purchase and use of our products and services (collectively, the “Services”). By accessing the Services or purchasing our products, you agree to these Terms and to our Privacy Policy.
If you do not agree, do not use the Services.
1. Overview of the Services
myBloom offers premium frozen smoothie kits and related products for one-time purchase or through recurring subscription. Our Services are operated on Shopify, and we use third-party providers such as subscription management providers, email/SMS communication platforms, analytics providers, and advertising networks. Payments are processed through providers such as Shopify Payments (powered by Stripe) and PayPal.
2. Eligibility & Accounts
- You must be 18+ (or the age of majority in your jurisdiction) to use the Services.
- If you create an account, you must provide accurate information and maintain the security of your login. You’re responsible for all activity under your account.
- We may suspend or terminate accounts for suspected fraud, misuse, or violations of these Terms.
3. Acceptable Use
You agree not to: (a) use the Services for unlawful purposes; (b) post or transmit infringing, deceptive, defamatory, obscene, or harmful content; (c) attempt to access data or systems without authorization; (d) use automated scraping or data mining tools; (e) interfere with the operation or security of the Services.
4. Purchases, Subscriptions & Billing
- One-Time Orders. Orders are subject to availability and our acceptance.
- Subscriptions. If you enroll in a subscription, you authorize recurring charges to your payment method at the interval you select until you cancel. You may skip or cancel at any time through your account, but changes must be made 5 days prior to order shipment.
- Payment Processing. Payments are securely processed by Shopify Payments (powered by Stripe), PayPal and others. Their terms and privacy policies govern their processing of your information. You authorize us and our processors to charge your payment method for orders, subscriptions, taxes, shipping, and applicable fees.
- Pricing & Taxes. All prices are in U.S. dollars and subject to change. Taxes will be collected where required.
5. Shipping, Risk of Loss & Availability
- Shipping and handling fees are displayed at checkout and may change.
- We ship via third-party carriers. Title and risk of loss pass to you once the order is delivered by the carrier to the shipping address.
- Deliveries may be delayed due to weather, carrier issues, or events beyond our control. If timely delivery is not possible, we may cancel and issue a credit or refund.
- We may change, discontinue, or limit products or services at any time without liability.
6. Perishable Products, Inspection & Food Safety

Our products are perishable and shipped frozen/packed for transit. Inspect immediately upon delivery and place in freezer.

Store frozen (< 0°F) upon receipt and follow all preparation instructions.

Allergen notice: Products may contain, or be produced or packed in facilities that handle, common allergens (e.g., milk, wheat, egg, soy, fish, shellfish, peanuts, tree nuts, sesame). Cross-contact may occur. Always read labels before use.

Do not consume any product that appears compromised.
7. Returns, Replacements & Refunds (Perishable Goods)
Because our products are perishable, returns are not accepted.
If your order arrives damaged, thawed, or incorrect, contact hello@mybloom-superfoods.com within 7 days of delivery with photos and your order number. At our discretion, we may provide a replacement, credit, or refund. We may require further information via forms, photos, packaging details, or proof of issue to process a resolution.
8. Promotions, Discounts & Gift Cards

Promotions/discounts are limited-time and subject to their stated terms.

Promotional credits have no cash value and may expire.

Gift cards (if offered) are not redeemable for cash (except as required by law), not reloadable, and myBloom is not responsible for lost or stolen cards.
9. Communications; Email & SMS
By purchasing or creating an account, you agree to receive transactional communications (e.g., order updates). With your consent, we may send marketing emails or SMS. Message & data rates may apply; frequency varies. You may unsubscribe or reply STOP to opt out. Consent to marketing is not a condition of purchase. 10. User Content & Feedback
If you submit reviews, photos, testimonials, or other content (“User Content”), you represent that you own it or have rights to share it, and that it does not infringe others’ rights or violate laws. You grant myBloom a nonexclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, publish, display, distribute, and create derivative works from your User Content in any media for lawful purposes (including marketing).
Any suggestions or feedback you provide may be used without compensation.
11. Intellectual Property
All content, trademarks, logos, and materials on the Services are owned by myBloom or its licensors and are protected by IP laws. We grant you a limited, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes. You may not copy, modify, distribute, reverse engineer, or exploit the Services or content except as expressly permitted in writing.
12. Health & Nutrition Disclaimer
Nutrition information provided on our website or packaging is general in nature and not medical advice. Always consult a qualified healthcare provider before making dietary changes, particularly if you have health conditions, allergies, or are pregnant or nursing. myBloom products have not been evaluated by the FDA and are not intended to diagnose, treat, cure or prevent disease.
13. Third-Party Tools & Links
We may provide access to third-party tools or websites. We do not control and are not responsible for third-party sites, tools, or policies. Your use of them is at your own risk and subject to their terms.
14. Disclaimers

AS-IS BASIS. The Services, content, and products are provided “as is” and “as available.”

NO WARRANTIES. To the fullest extent permitted by law, we disclaim all warranties, express or implied (including merchantability, fitness for a particular purpose, title, non-infringement).
15. Limitation of Liability
To the fullest extent permitted by law, myBloom and its affiliates, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; or for lost profits, loss of data, or business interruption.
Our total liability for any claim will not exceed the amount you paid for the product(s) giving rise to the claim in the one (1) month preceding the event. Some jurisdictions do not allow certain limitations; liability is limited to the maximum extent permitted.
16. Indemnification
You agree to indemnify and hold harmless myBloom and its affiliates, officers, employees, and agents from claims, damages, liabilities, and expenses (including attorneys’ fees) arising out of your use of the Services, your User Content, or violation of these Terms or law.
17. Dispute Resolution; Arbitration; Class Action Waiver
Informal Resolution. Before filing a claim, email hello@mybloom-superfoods.com with a written notice of the dispute so a resolution may be mutually agreed upon in a timely manner.
Binding Arbitration. Except for small-claims matters or IP disputes, any dispute will be resolved by binding, individual arbitration administered by JAMS under its Streamlined Arbitration Rules and the Federal Arbitration Act. Judgment may be entered in any court of competent jurisdiction.
No Class Actions. You and myBloom waive any right to participate in class or representative actions. Arbitration proceeds only on an individual basis.
Opt-Out. You may opt out of arbitration (but not the class waiver) by mailing a notice to Arctic Fox, 4845 Pearl East Circle, Boulder, CO 80301 within 30 days of first agreeing to these Terms.
18. Changes to the Services or Terms
We may update these Terms at any time. If material changes occur, we will post the revised Terms and update the effective date. Continued use after changes means acceptance.
19. Miscellaneous

Severability. If any provision is held invalid, the remainder remains in effect.

Assignment. You may not assign these Terms; we may assign without restriction.

Entire Agreement. These Terms and our Privacy Policy are the entire agreement between you and myBloom regarding the Services.
